The Rights of the Accused is a group of political and civil rights that applies to an individual who is accused of a crime. The Rights of the Accused start when he or she is first arrested and charged to when the individual is either acquitted or convicted. The Rights of the accused are usually based on the idea of "innocent until proven guilty" and are a part of due process. In the United States, the Rights of the Accused are guaranteed in the Bill of Rights in the Constitution. More specifically, these rights are seen in the 4th, 5th, 6th, and 8th Amendments. When a person is arrested and charged with a crime, the individual is guaranteed rights aimed at insuring that the proceedings which follow are fair.
